1. Acceptance of Terms
Welcome to Eliyahu Pereira. These Terms of Service ("Terms") govern your use of our website, eliyahupereira.com (the "Site"), and all related content, services, and products, including our online community, mentorship programs, and in-person study opportunities (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.
2. Intellectual Property Rights
All content provided through the Services, including but not limited to text, graphics, videos, logos, and course materials, is the exclusive property of Eliyahu Pereira and is protected by international copyright laws. You are granted a limited, non-exclusive, revocable license to access the content for your personal, non-commercial use. You may share short clips or excerpts of our public content, provided that you give clear and prominent attribution to "Eliyahu Pereira" and link back to our Site where possible.
3. User-Generated Content
You retain full ownership of any content you submit or create within our community spaces ("User Content"). By submitting User Content, you grant Eliyahu Pereira a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and providing the Services to you and other users. We will never use your User Content for marketing or other purposes without your express written permission.
4. Code of Conduct for Community Spaces (e.g., "The Gate")
Our community is a sacred space for profound work. By participating, you agree to:
Maintain Respect: Engage with all members and staff with honor and respect, even in disagreement.
Ensure Confidentiality: What is shared in the group, stays in the group. Do not share any member's personal information or story outside of the community.
Prohibited Conduct: You may not engage in hate speech, harassment, spamming, soliciting other members, or any illegal activities.
Eliyahu Pereira reserves the right, in its sole discretion, to remove any member from the community for a violation of this Code of Conduct, without refund.
5. Terms of Specific Services
A. Courses & Community ("The Gate"):
Billing: This service is offered on a recurring monthly subscription basis.
Cancellation: You may cancel your membership at any time through your account settings. Cancellation will be effective at the end of the current billing period.
Refunds: Due to the immediate access to a significant library of digital course material upon purchase, we do not offer refunds for The Gate membership.
B. 1:1 Spiritual Coaching ("The Direct Path"):
Disclaimer: You explicitly acknowledge and agree that this Service is for educational and spiritual mentorship purposes only. It is NOT a substitute for professional medical advice, mental health therapy, financial counsel, or legal advice. You should consult with qualified professionals for any such needs.
Confidentiality: All one-to-one sessions are held in the strictest confidence. This confidentiality is absolute, with the only exceptions being where disclosure is required by law or to prevent imminent harm to yourself or others.
Scheduling: All appointments may be rescheduled without penalty with at least 48 hours' notice. A failure to attend a scheduled session ("no-show") will be addressed with a private conversation to determine the best path forward.
C. Learn in Tzfat (The Beit Midrash):
Waiver of Liability: All students are required to sign a comprehensive waiver of liability prior to their arrival, covering all aspects of in-person study, travel, and related activities.
Personal Responsibility: Students are 100% responsible for arranging and funding their own travel, lodging, and personal accommodations unless otherwise specified in a particular program.
Refunds: A full refund of tuition is available for cancellations made up to 72 hours prior to the scheduled arrival date. Cancellations made within 72 hours of arrival are non-refundable.
6. Fundraising & Donations
Eliyahu Pereira is a non-profit organization (U.S. 501(c)(3) status pending). Funds raised are used to support our mission, which includes, but is not limited to, sponsoring students, providing free teachings, funding community causes in Tzfat, and sustaining the operational needs of the Sha'ar HaYichud Learning Center. 7. Limitation of Liability & Disclaimer of Warranties
The Services are provided "as is." To the fullest extent permitted by law, Eliyahu Pereira disclaims all warranties, express or implied. In no event shall Eliyahu Pereira be liable for any indirect, incidental, special, or consequential damages. Our total liability to you for any claim arising out of or relating to the Services is limited to the amount you have paid for the Service in question.
8. Dispute Resolution & Governing Law
Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be resolved through private, binding arbitration.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Israel. The exclusive venue for any arbitration shall be Tzfat, Israel.
